Please note: By requesting a quote, you confirm that you’ve read and agree to our terms and conditions below.
It is common practice for a client to arrange transportation of vehicles with Boats and Bikes by Road (Pty) Ltd. Such arrangements shall include the preparation and submission of the necessary documentation required by Boats and Bikes by Road (Pty) Ltd relating to the transportation of the vehicle or vehicles, and the delivery of such documentation to Boats and Bikes by Road (Pty) Ltd in either electronic form (via email) or by hand (hard copy). By confirmation of receipt of said documentation, the client shall be deemed to have read and accepted the terms and conditions contained therein and agrees to be contractually bound thereby. The onus is on the client to provide the required documentation to Boats and Bikes by Road (Pty) Ltd prior to the transportation of the client’s vehicle or cargo. No contractual arrangement between the client and Boats and Bikes by Road (Pty) Ltd will be deemed to exist until said documentation has been received by Boats and Bikes by Road (Pty) Ltd.
Collection and Delivery
Our schedule planning only finalizes once load volumes are sufficient, because empty trips are costly and senseless.
While every effort is made by Boats and Bikes by Road (Pty) Ltd to adhere to delivery and collections and requirements of senders and recipients, we are not to be held responsible for any unforeseen delays beyond our control. The quoted dates and times are not guaranteed, and Boats and Bikes by Road (Pty) Ltd does not accept liability for any costs incurred by the client as a result of any delays that may occur.
The client shall, in addition to Boats and Bikes by Road (Pty) Ltd.’s normal fees for services rendered, be liable for any costs arising from the changes to instructions for collection or delivery and in respect of changes made by the client for collection or delivery of a vehicle where it transpired that the subject vehicle was not available for collection or was not ready for delivery.
Where an emergency may arise for collection or delivery, Boats and Bikes by Road (Pty) Ltd may consider alternative arrangements to suit the client. All additional costs will be for the client’s account.
Boats and Bikes by Road (Pty) Ltd will make the arrangements for the transport vehicle to collect and deliver the goods at the designated address. Should the collection or delivery not be possible due to the area not being assessable, alternative arrangements shall be made at the client’s cost.
If we are unable to deliver a vehicle (goods) for any reason whatsoever, you will be notified, and we will require you to furnish us with instructions. If you do not furnish us with timeous instructions, you will be liable for our costs and expenses, in addition to any additional tariffs and fees that we may levy.
The client is urged to provide Boats and Bikes by Road (Pty) Ltd with details of its representatives who can easily be contacted to receive confirmation in respect of a collection and/or delivery.
Any matter between the client and its suppliers for any reason whatsoever will be referred by the client to its supplier for resolution. Failing to resolve such matter, Boats and Bikes by Road (Pty) Ltd reserves the right to postpone or cancel the quotation, and any costs incurred by Boats and Bikes by Road (Pty) Ltd in resolving such matters, shall be for the account of the client.
Confirmation by Boats and Bikes by Road (Pty) Ltd of the terms and conditions hereof in respect of delivery and collection arrangements and any special requirements pertaining thereto shall only be made on receipt of a signed (or electronic) acceptance of these conditions and payment of the transport charges as provided for in the quotation.
All goods collected/delivered must have a detailed inventory documented.
Boats and Bikes by Road (Pty) Ltd will undertake any external vehicle inspection before both collection and delivery, which check will note any clearly visible scratches or damages to the bodywork. The inspection shall be deemed not to have included any mechanical or latent defects for which Boats and Bikes by Road (Pty) Ltd will not be liable.
Batteries on all vehicles are considered limited life items and as such are the sole responsibility of the client.
Boats and Bikes by Road (Pty) Ltd may agree to transport goods along with a client’s vehicle, including but not limited to jackets, helmets, boots and spare parts. These items should be clearly listed on the quote form. Boats and Bikes by Road (Pty) Ltd will not be held responsible for any loss or damages to such items.
Boats and Bikes by Road (Pty) Ltd will not transport any items NOT agreed to and NOT specified on the quote form.
“It is our sole purpose to deliver a good professional service, your item be it a motorcycle/boat/caravan or other cargo, it will be strictly handled and treated with the outer most respect as if it were our own. Due to the distances that we travel to make sure that your Leisure item gets to you in the same condition as showroom quality or how we have received it in. Please refrain from making unnecessary calls to the Driver/s as it adds a lot of undesired pressure, we have to deal with a lot of issues on the roads,(road blocks, weight bridges, SAPS stop & searches, weather – gust winds, even tiredness of driver/s including customers that are not available for deliveries and/or even break-downs or travelling in closed vehicles, this all contributes to unnecessary and unforeseen delays to shared-load and/or direct load trips. Please bare & be patient for the safety of your items”
Licenses and Permits
In the event of the vehicle being transported on a trailer supplied and loaded by the client, the client shall be responsible for ensuring that the trailer is correctly licensed and is in a roadworthy condition, has a spare wheel and that the trailer lights are wired according to the SABS specification and in working order. All costs of repairs, traffic fines or recovery of the trailer will be for the account of the client and payable when required.
We shall not be obliged to transport any dangerous or illegal goods, or goods unlawfully obtained. If, in our sole discretion, goods are illegal or unlawfully obtained we may refuse to transport such goods and will not be liable to the client in any manner whatsoever.
All documentation required for the transport of the goods are prepared and correct.
Any necessary permits should be supplied by the client.
Cancellations
In the event of a client cancelling a booking after acceptance of the booking by Boats and Bikes by Road (Pty) Ltd, the client shall be liable for the payment of cancellation fees calculated at:
- 50% (fifty percent) of the quoted transportation cost in the event of notification of cancellation being given less than 12 (twelve) hours prior to the agreed collection time.
- 25% (twenty five percent) of the quoted transportation cost in the event of notification of cancellation being given more than 12 (twelve) hours prior to the agreed collection time.
Terms Of Payments
Payments for the performed services are to be made according to the issued invoice within the term of payment defined in the offer.
Payment shall be made in full, strictly in advance of collection and/or delivery.
The term of payment begins with the issue date of the invoice.
All payments must be paid in full and bank fees and any transfer costs are for the client’s account. Short payments will require re-payments from the client.
Payment should either be made in cash by hand at pick-up or in Boats and Bikes by Road (Pty) Ltd.’s nominated account.
In the event of a failure to pay invoices within the term of payment, the issuing party is entitled to a contractual penalty equal to 0.05% for each day of delay.
If payment is made via cash deposit in Boats and Bikes by Road (Pty) Ltd.’s bank account, an additional fee will be charged to cover the cash deposit fee.
NO PICK UP/COLLECTION WILL BE DONE WITHOUT UPFRONT CASH PAYMENT OR PAYMENT SHOWING ON BANK STATEMENTS.IF YOU ARE NOT FROM ABSA or FNB BANK, PLEASE MAKE AN IMMEDIATE PAYMENT.
Insurance
Boats and Bikes by Road (Pty) Ltd carries GIT (Goods in Transit) insurance, subject to a maximum value of R2,000,000 (two million rand) per motor vehicle. Please note that if you want GIT cover for your item being transported, an extra fee will be added for your account. Furthermore, our GIT cover is offered to the client on condition that the client has its own cover on its asset(s) that, in the event of the claim by the client rising from specified damages to goods in transit, Boats and Bikes by Road (Pty) Ltd.’s liability shall be limited to the sum authorized by the assessor appointed by the insurance company. The balance of any claim over and above such authorized amount shall be for the account of the client.
In the event of loss or damages to a client’s asset(s) arising from an incident or accident in which Boats and Bikes by Road (Pty) Ltd cannot be deemed to be responsible, any claim for such loss or damages should be lodged under the client’s insurance cover.
In case of an overload of the vehicle, the applicant is obliged to bear all additional costs for the overload.
The contractual partner is not entitled to claim damages if Boats and Bikes by Road (Pty) Ltd proves based on documents that it did not cause the damages.
If an entire consignment or part of it thereof is lost during transportation, the driver is fully responsible for the loss. The driver is not responsible if he proves that he was not able to avert the damage. All parts regarding unit must be fitted properly.
In the event of a claim being submitted through Boats and Bikes by Road (Pty) Ltd.’s insurers, the client shall be liable for the excess as determined by the insurers, subject to Boats and Bikes by Road (Pty) Ltd.’s contributing a maximum of 50% (fifty percent) of any such excess, provided that Boats and Bikes by Road (Pty) Ltd.’s contribution shall not exceed R7,500-00 (seven thousand five hundred rand).Any additional portion of the excess over and above this maximum of R7,500-00 (seven thousand five hundred rand) shall be for the account of the client.
Any amount claimed which exceeds the assessor’s authorized amount, and/or the maximum value of R150 000-00 (one hundred and fifty thousand rand) per vehicle, shall be for the client’s account unless Boats and Bikes by Road (Pty) Ltd has agreed to a variation which has been recorded in writing.
Boats and Bikes by Road (Pty) Ltd.’s insurance policy does not cover, nor will we be liable for:
- Loss of windscreens, panniers, side panels and any removable or detachable items. The client shall be responsible for ensuring that such items are firmly attached to the vehicle or removed to be transported separately.
Unless otherwise agreed in writing, damage from stone chips and other items thrown up from the road by open road vehicles or trailers of the transporter or other vehicle(s) using the road.
- Loss or damage arising from protest action while vehicles are in transit, including but not limited to arson, rioting and airborne missiles.
- Loss or damage due to Acts of God or other causes, for example but not limited to, hail, storms, wind, lightening, falling trees, flying stones or rocks, mechanical or electrical faults, and road accidents in respect of which Boats and Bikes by Road (Pty) Ltd cannot be deemed to be responsible or to have had control over.
- While Boats and Bikes by Road (Pty) Ltd shall always endeavor to ensure the security of vehicles whilst in transit, Boats and Bikes by Road disclaims any and all liability for any losses or damages arising due to theft or hijacking of the transportation vehicle/trailer whilst in transit.
Boats and Bikes by Road (Pty) Ltd does not offer insurance cover for vehicles classified as vintage, collector’s items, exotic or custom. Boats and Bikes by Road will in its sole discretion determine whether a client’s vehicle fall within the aforesaid classification.
Boats and Bikes by Road (Pty) Ltd does not offer insurance cover on accident-damaged vehicles from salvage or insurance companies or auction houses. This includes any loose parts of the vehicle which needs to be transported separately.
Should Boats and Bikes by Road (Pty) Ltd make use of a third-party contractor for the transport of a client’s vehicle, Boats and Bikes by Road undertakes to inform the client, either telephonically or in writing, of such arrangement, following which the client will be deemed to have agreed to same unless the client indicates otherwise. In this event, the contractual agreement between Boats and Bikes by Road (Pty) Ltd and the client will be nullified, and replaced by the third-party contractor’s terms and conditions and such insurance cover as the third-party contractor has in place.
In the event of a claim being made through Boats and Bikes by Road (Pty) Ltd.’s insurers, should Boats and Bikes by Road (Pty) Ltd.’s insurers decline to process such claim for whatsoever reason, Boats and Bikes by Road (Pty) Ltd disclaims all liability for the loss and or damages forming the basis of such claim, and such claim will be referred to the client’s insurers for resolution.
All costs involved in case of accidents (storage fees and transport fees) shall be for the client’s account.
A copy of Boats and Bikes by Road (Pty) Ltd.’s GIT insurance is available on request.
Penalties and additional fees
In the event of a cash deposit made into Boats and Bikes by Road (Pty) Ltd.’s bank account, an additional fee will be charged to cover bank fees.
In case of an accident, all costs, for example storage fees or additional transport fees, shall be for the client’s account.
Any traffic fines, in case of vehicles not being roadworthy or not having the necessary permits, will be for the client’s account.
Should there by any delay while transporting the vehicle (repair or breakage of client’s asset(s)) beyond Boats and Bikes (Pty) Ltd by Road’s control, any costs for guesthouse stay will be for the client’s account.
A standing fee of R250-00 (two hundred and fifty rand) per hour will be charged by Boats and Bikes by Road (Pty) Ltd in case of breakage to client’s asset(s) beyond Boats and Bikes by Road (Pty) Ltd.’s control
In case of pick up or delivery delay by client, a standing fee of R250-00 (two hundred and fifty rand) per hour will be charged.
All breakage and repairs to client’s vehicle or asset(s) will be for client’s account.
Collection address
Please ensure that the keys are with the item when we collect. Should you send paperwork with, it must be sealed in a pre-addressed envelope. Helmets etc. are only taken if space is available, arranged before-hand, packaged & addressed.
Kindly advise trading hours if you provide a Work of Dealership address. Otherwise please do plan for after-hours deliveries as waiting time for Work or Dealership to open in the morning is charged at R150 per hour.
